1. Agreement to These Terms

These Terms of Service ("Terms") govern all transportation services provided by [LEGAL ENTITY NAME], doing business as Party Bus of Los Angeles ("we", "us", "our"), and all use of the website at partybusoflosangeles.com. By requesting a quote, placing a reservation, riding in one of our vehicles, or using this website, you agree to these Terms on behalf of yourself and every member of your group.

If you do not agree with these Terms, please do not book with us or use the site.

2. Definitions

Client means the person or organization that places and pays for a reservation. Passenger means anyone who rides in one of our vehicles under that reservation. Charter means the specific trip described in your confirmation, including the vehicle, date, pickup time, hours and itinerary. Chauffeur means the driver we assign to your charter.

The Client is responsible for the conduct of every Passenger in their group, including minors, and for any charges those Passengers cause under these Terms.

3. Reservations and Confirmation

Submitting a quote request through our website or by phone does not reserve a vehicle. A reservation is confirmed only when we send you a written confirmation and receive any deposit required under Section 5. Vehicles and dates are released on a first confirmed basis, so peak dates can sell out while a quote is pending.

You are responsible for giving us accurate pickup addresses, contact numbers, passenger counts and timing. We are not responsible for missed pickups caused by incorrect or incomplete information.

4. Quotes and Pricing

Pricing depends on the vehicle, group size, date, pickup area and number of hours reserved, and rates vary on peak dates such as prom season, holidays and New Year's Eve. Every quote is prepared for a specific trip.

Unless stated otherwise in writing, a quote is valid for [NUMBER] days from the date issued and is subject to vehicle availability at the time you confirm. Quoted amounts do not include gratuity unless the confirmation says so. Applicable taxes, fees and surcharges are shown on your confirmation.

5. Payment and Deposits

We may require a valid credit card on file for the duration of the charter to cover overtime, cleaning or damage charges described in these Terms. Charges that arise during or after a charter may be applied to that card.

6. Cancellations and Refunds

Cancellations must be sent to us in writing. The following applies unless your confirmation states otherwise:

• No show at the scheduled pickup time: [NO SHOW TERMS]

If our chauffeur waits at the pickup location and the group does not appear within [GRACE PERIOD] of the scheduled time, and we cannot reach the Client, the charter may be treated as a no show.

If we must cancel a charter for a reason within our control and cannot supply a comparable vehicle, you receive a full refund of amounts paid for that charter.

7. Itinerary Changes and Overtime

Tell us about itinerary changes as early as possible. We will accommodate changes when the schedule and vehicle availability allow, and additional stops or extended distance may change the price.

Charters run for the hours reserved. If your group keeps the vehicle past the reserved end time, overtime is billed at [OVERTIME RATE AND INCREMENT], subject to the chauffeur's availability and hours of service limits. Overtime cannot be guaranteed, since the vehicle may be scheduled for another charter.

8. Passenger Capacity

Each vehicle has a maximum passenger capacity that may not be exceeded for any reason. Capacity is set by the vehicle manufacturer and applicable regulations, not by preference. Passengers beyond capacity will not be permitted to board, and no refund is due for a group that arrives larger than the vehicle reserved.

Confirm your final headcount with us before your date so we can assign the right vehicle.

9. Passenger Conduct and Safety

Passengers must follow all reasonable instructions from the chauffeur, who is responsible for the safe operation of the vehicle. Passengers must remain seated while the vehicle is in motion where seating is provided, keep hands and objects inside the vehicle, and refrain from interfering with the chauffeur or the vehicle's controls.

We reserve the right to end a charter immediately, without refund, if any Passenger behaves in a way that is unsafe, unlawful, abusive toward our staff, or that risks damage to the vehicle. In that case the group is responsible for its own onward transportation.

10. Alcohol Policy

Alcohol is permitted on board only where allowed by California law and only when every Passenger in the vehicle is of legal drinking age. If any Passenger is under 21, no alcohol may be present in the vehicle at any time, and our chauffeur may remove alcohol from the vehicle or end the charter.

The Client is responsible for verifying the age of everyone in their group. Open containers are not permitted in the front passenger compartment, and no alcohol may leave the vehicle at any stop. Our chauffeurs may refuse service to any Passenger who appears intoxicated to the point of risking their own safety or the safety of others.

11. Smoking, Vaping and Controlled Substances

Smoking and vaping of any kind are prohibited in all vehicles. Illegal drugs and any unlawful activity are strictly prohibited, and any Passenger in possession of them will result in immediate termination of the charter without refund, and may involve law enforcement.

12. Damage, Cleaning and Excessive Wear

The Client is financially responsible for damage caused by any member of their group, including torn or stained upholstery, broken glassware or fixtures, damage to audio, lighting or video equipment, and damage to the vehicle body or interior.

Charges may include a cleaning fee of [CLEANING FEE] for spills or sickness requiring detailing, plus the actual cost of repair or replacement, plus any lost revenue for time the vehicle is out of service. These charges may be applied to the card on file.

13. Delays, Traffic and Events Beyond Our Control

We plan routes with Los Angeles traffic in mind, but we cannot guarantee arrival times. We are not liable for delays or missed events caused by traffic, road closures, accidents, weather, mechanical failure, acts of government, labor actions, civil unrest, natural disasters or other events beyond our reasonable control.

If a mechanical issue prevents a vehicle from completing a charter, we will make reasonable efforts to supply a replacement vehicle. If we cannot, our responsibility is limited to a refund of the unused portion of the charter.

14. Vehicle Substitution

We reserve the right to substitute a vehicle of equal or greater capacity when the reserved vehicle becomes unavailable due to mechanical issues, damage from a prior charter or other operational necessity. Photographs on this website represent our fleet and vehicle types, and the specific vehicle assigned to your charter may differ in appearance.

15. Personal Property

Passengers are responsible for their own belongings. We are not liable for items lost, left behind, stolen or damaged in our vehicles. If you leave something behind, contact us as soon as possible and we will make reasonable efforts to locate and return it. Unclaimed items may be discarded after [HOLDING PERIOD].

16. Licensing and Insurance

We operate as a licensed and insured passenger carrier in the State of California under TCP number [TCP NUMBER], and we carry the commercial liability coverage required for our vehicle classes. Proof of insurance is available on request for corporate and venue requirements.

17. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any charter is limited to the amount you paid for that charter. We are not liable for indirect, incidental, special, consequential or punitive damages, including missed events, lost profits or lost opportunities.

Nothing in these Terms limits liability that cannot be limited under California law, including liability for death or personal injury caused by negligence.

18. Communications and Text Messages

When you submit a form on this website and provide your phone number, you agree that we may contact you by phone, text message and email about your quote request and reservation. Message and data rates may apply, and message frequency varies. You can opt out of text messages at any time by replying STOP, or ask for help by replying HELP. Opting out of marketing messages does not stop transactional messages about a booking you have already made.

19. Privacy

20. Website Content

The content on this website, including text, photographs, graphics and the layout, is owned by us or used with permission and may not be copied or reused without written consent. We work to keep the information on this site accurate and current, but we do not warrant that it is free of errors, and site content does not form part of any contract unless repeated in your written confirmation.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of these Terms or any charter will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

If any provision of these Terms is found unenforceable, the rest remains in full effect.

22. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time you confirm a reservation is the version that applies to that reservation. The date at the top of this page shows when it was last revised.
